How supplement regulation actually works
There is a lot of confusion here, and getting it wrong is expensive. The short version:
Nutritional supplements and vitamins are not pre-approved by the FDA. The FDA does not have authority over whether vitamins and supplements can be sold at all.
However — and this is the part people miss — like any other food product, supplements must comply with FDA regulations on labeling and manufacturing.
Provisions, laboratory production controls and distribution guidelines for supplements and cosmetics are regulated under the Food, Drug and Cosmetic Act, specifically Code of Federal Regulations Title 21, Section 111. The Current Good Manufacturing Practices required under CFR-21-111 ensure testing is performed on every raw material in a supplement — measuring purity, potency, identity and contaminants to prove the product meets all applicable standards. cGMPs also provide a statistically valid method for substantiating label claims on finished products.
Because there's no pre-approval, the responsibility sits with the manufacturer. That's exactly why private labeling with a properly certified provider is the lower-risk route: we make sure products are safe and market-ready before they ever carry your name.
How to judge any supplement manufacturer
Use this on us, and on everyone else you're considering. A provider who hesitates on any of these is telling you something.
- Is the manufacturer FDA registered?
- Is their cGMP certification current?
- Do they have on-site regulatory and quality control departments?
- Are they certified non-GMO, hypoallergenic and free of heavy metals?
- Is their ingredient selection backed by clinical research?
- Were the formulas created by doctors or nutritional experts?
- Do they employ third-party testing?
- Will they hand over compliance documentation on request?
You can also search publicly for product recalls and truth-in-labeling violations against any provider. It takes five minutes and it's worth doing.
Where you stand as a private label partner
As a private label customer, you have protection from the associated manufacturing liabilities — provided you follow our labeling guidelines.
Those guidelines exist for a reason. Certain label content is required by regulation and must not be modified: net content, product description, product unit count, the Supplement Facts box and panel format, directions, suggested use, servings information, warnings and the FDA statement.
Everything else — your logo, your colors, your brand voice, your typography — is yours to design however you want. We supply every template and specification your designer needs to keep the compliant parts compliant.
The five mandatory elements
- Statement of identity — the name of the dietary supplement in the package
- Net quantity of contents — the overall amount in the package
- Nutrition labeling — the Supplement Facts panel
- Ingredient list — all ingredients included in the supplement
- Business information — name and place of the manufacturer, packer or distributor
What your designer needs to know
Get these right the first time and your labels print cleanly. Get them wrong and you lose a week.
Color mode
Design all artwork as CMYK, not RGB. Prints CMYK with gloss or matte lamination.
Image resolution
Any image files must be 300dpi or greater.
Small black text
Build small black text as 100% Black rather than CMYK, so it prints cleanly without registration issues.
Bleed
Any graphic that runs to the edge must bleed at least 1/16" past the dieline for die-cut registration tolerance.
Clear space
Any text or graphic that doesn't bleed must sit at least 1/16" inside the label's edge.
File prep
Convert fonts to outlines and embed linked images in the final press-ready PDF.
Material: white BOPP with permanent adhesive, delivered on 3" core rolls, unwind direction #4, maximum 1,000 labels per roll. We provide the exact dieline for every SKU.
